Booking Policy: All coaching sessions, whether online or in-person, must be booked through our website. Bookings are subject to availability and will be confirmed via email.
Cancellation Policy: Cancellations must be made at least 24 hours in advance. Cancellations made within 24 hours of the scheduled session may incur a cancellation fee.
Rescheduling Policy: Clients may reschedule sessions up to 24 hours in advance without any additional charges. Rescheduling within 24 hours of the session may be subject to availability and potential fees.
11. Zoom Sessions
Technical Requirements: Clients are responsible for ensuring they have the necessary technical requirements, including a stable internet connection, to participate in Zoom sessions.
Confidentiality: Zoom sessions are confidential. Clients agree not to record or distribute any part of the session without prior written consent from Winnertality.
Conduct: Clients must conduct themselves appropriately during Zoom sessions. Winnertality reserves the right to terminate a session if the client engages in inappropriate behavior.
12. In-Person Sessions
Health and Safety: Clients must adhere to any health and safety guidelines provided by Winnertality. This includes, but is not limited to, wearing masks if required, maintaining social distancing, and following any other health protocols.
Location: In-person sessions will be conducted at agreed-upon locations. Clients are responsible for their own transportation to and from the session location.
Conduct: Clients must conduct themselves appropriately during in-person sessions. Winnertality reserves the right to terminate a session if the client engages in inappropriate behavior.
13. Payments
Payment Terms: Payments for coaching sessions must be made in advance through our secure online payment system. We accept major credit cards and other specified payment methods.
Refund Policy: Refunds will be provided only if a session is cancelled by Winnertality or under special circumstances at the discretion of Winnertality. Refunds for client-initiated cancellations will be subject to our cancellation policy. No refunds will be given for cancellations made less than 24 hours before the session or for no-shows.
Late Payments: Late payments may incur additional fees. Continuous non-payment may result in suspension of services.
14. Security and Insurance
Assumption of Risk: Participation in physical and mental coaching sessions, whether online or in-person, involves inherent risks. By participating, clients acknowledge and accept these risks, including but not limited to, the risk of injury.
Waiver of Liability: Winnertality is not responsible for any injuries sustained during coaching sessions. Clients agree to hold Winnertality harmless from any claims, demands, or causes of action arising out of or related to their participation in the coaching sessions.
Insurance: It is the responsibility of the client to ensure they have adequate personal insurance coverage for any injuries sustained during the sessions. Winnertality does not provide health, medical, or personal injury insurance for clients.
15. Governing Law
Any claim related to Winnertality's Website shall be governed by the laws of France without regard to its conflict of law provisions.
16. Indemnification
You agree to indemnify, defend, and hold harmless Winnertality, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of or inability to use the Website or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.
